DMCA Policy

Crisi Salernitana respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

This policy outlines the procedures for reporting alleged copyright infringement and for submitting a counter-notification if your content has been removed in error.

Filing a DMCA Notice of Copyright Infringement

If you believe that any content appearing on Crisi Salernitana infringes upon your copyright, please send a notice of infringement to our designated Copyright Agent with all of the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and where it is located on our website (e.g., URL link).
  3. Your contact information: Your name, address, telephone number, and email address.
  4. A statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

Upon receipt of a valid DMCA notice, Crisi Salernitana will promptly remove or disable access to the allegedly infringing material and take reasonable steps to notify the user who posted the material.

Filing a DMCA Counter-Notification

If your content has been removed from Crisi Salernitana as a result of a copyright infringement notice, and you believe that the material was removed or disabled by mistake or misidentification, you may send a counter-notification to our Copyright Agent. Your counter-notification must include all of the following information:

  • Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • Statement of mistake or misidentification: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Your name, address, and telephone number.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Crisi Salernitana may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Electronic or physical signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, Crisi Salernitana will send a copy of the counter-notification to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored within 10 to 14 business days after receipt of the counter-notification.
